Membership + Package Policy

Welcome to Beauté Clinique Spa. By purchasing a package or enrolling in a BCSpa membership, you acknowledge that you have read, understood, and agreed to this Membership + Package Policy, our Terms & Conditions, Cancellation & Appointment Policy, Returns & Refund Policy, Privacy Policy, and any terms presented during enrollment or purchase.


1. Membership Overview 

1.1.  Purpose of Membership  

  • BCSpa memberships and packages are designed to provide clients with convenient access to qualifying massage therapy, skincare, recovery, and wellness services while offering benefits, flexibility, or savings based on the selected plan or package. 

1.2.    Membership Agreement 

  • The membership description, pricing, included services, billing schedule, and renewal terms presented during enrollment become part of the member’s agreement with BCSpa. 


2.  Membership Eligibility 

2.1.   Age Requirement

  • Members must be at least 18 years old to purchase a membership. Services for clients under 18 require the consent and participation of a parent or legal guardian in accordance with BCSpa policies and applicable law. 

2.2.    Member Account 

  •  Each membership must be registered under the member’s legal name with accurate contact and payment information. 

2.3.    Non-Transferability 

  •  Memberships and recurring benefits are intended solely for the individual named on the membership account and may not be sold, shared, or transferred unless the selected plan expressly includes transferable benefits.


3. Membership Plans, Packages + Benefits

3.1.    Available Memberships 

  •  BCSpa may offer monthly, annual, promotional, service-specific, or customized membership plans. Available plans, pricing, and included benefits will be disclosed before enrollment. 

3.2.     Included Services 

  •  Each membership includes the number and type of services, credits, enhancements, discounts, or other benefits described in the plan selected by the member. 

3.3.    Service Availability 

  •  Appointments remain subject to provider schedules, service eligibility, location, equipment availability, and any applicable health or safety requirements. Membership does not guarantee a particular provider, appointment time, or service location. 

3.4.     Excluded Charges 

  •  Unless expressly included in the selected plan, membership benefits do not cover gratuities, taxes, products, travel charges, parking, tolls, specialty equipment, third-party platform fees, or services outside the membership description. 


4.  Fees, Billing + Automatic Renewal 

4.1.     Membership Fees 

  •  Membership fees, billing frequency, enrollment charges, and applicable taxes will be disclosed before the member authorizes payment. 

4.2.     Automatic Renewal 

  •   A recurring membership will automatically renew at the frequency disclosed during enrollment until canceled. Before obtaining payment authorization, BCSpa will disclose the membership services, amount charged, billing frequency, renewal terms, and available cancellation methods. 

4.3.     Payment Authorization 

  •  By enrolling, the member authorizes BCSpa or its payment processor to charge the payment method provided for recurring membership fees and other approved charges. 

4.4.      Payment Information 

  •  Members are responsible for maintaining current payment and contact information and ensuring that sufficient funds are available on each billing date. 

4.5.     Failed Payments 

  •  If a payment is declined or remains unpaid, BCSpa may suspend membership benefits until the balance is resolved. Applicable returned-payment or processing fees may be charged when permitted and properly disclosed. 

4.6.      Price Changes

  •  Members will receive advance notice of material membership or price changes as required by applicable law. Continued billing at a revised price will occur only in accordance with the notice and consent requirements that apply. 


5. Services Included

5.1.     Scheduling Appointments 

  •  Members are encouraged to schedule appointments in advance. All appointments are subject to availability and are not guaranteed solely because a membership is active. 

5.2.     Membership Identification 

  •  Members may be required to verify their identity before redeeming membership services or benefits. 

5.3.      Benefit Redemption 

  •  Membership credits and services must be used in accordance with the plan selected. Benefits have no cash value and may not be exchanged for cash. 

5.4.     Rollover + Expiration 

  • Unused membership services or credits do not roll over unless rollover is expressly included in the selected membership plan. Membership expiration is governed by the selected plan. Package-credit expiration is governed by Section 6.5. Gift cards and gift certificates are governed by Section 6.9.

5.5.      Membership Discounts 

  •  Membership discounts apply only to eligible services and purchases. They may not be combined with other discounts, promotional rates, packages, or third-party offers unless expressly stated.


6. Package Credits + Redemption

6.1.     Package Purchases

  • BCSpa packages provide a prepaid number of treatment credits or services as described at the time of purchase.
  • Package pricing, included services, credit quantity, eligibility, and any promotional benefits will be disclosed before payment.
  • Purchasing a package does not create a recurring membership unless automatic renewal is expressly stated and separately authorized.

6.2.     Massage Credit Values

  • Credits cover treatment time only. Travel fees, specialty enhancements, gratuities, and services outside the package are charged separately.
  • Massage credits may be redeemed toward eligible BCSpa massage treatments according to the scheduled treatment duration:
  • ➡ 0.5 credit = 30 minutes
  • ➡ 1 credit = 60 minutes
  • ➡ 1.25 credits = 75 minutes
  • ➡ 1.5 credits = 90 minutes
  • ➡ 2 credits = 120 minutes
  • * Credits are deducted according to the full duration of the appointment booked.

6.3.      Credit Use 

  • Credits may be combined for eligible extended treatments.
  • Credits may not be divided into increments smaller than 0.5 credit.
  • Any remaining partial credit balance may be used toward a future eligible appointment while the package remains active.
  • Clients are not required to select the same appointment duration for every visit.
  • All services remain subject to provider availability, treatment eligibility, location, and scheduling availability.

6.4.     Eligible Services

  • Massage credits apply only to eligible BCSpa massage treatments unless the package description expressly includes additional services.
  • Credits may not be applied toward BCSrr services, equipment-based recovery services, skincare, hair-removal services, specialty treatments, retail products, gratuities, travel fees, taxes, or third-party charges unless specifically stated.
  • Premium enhancements or upgraded services may require an additional payment or additional credits.

6.5.      Package Expiration + Rollover

  • Package credits are valid for 18 months from the original purchase date unless a different validity period is disclosed at purchase.
  • Eligible unused credits may be extended for up to six additional months upon written request and approval by BCSpa.
  • Expired credits have no cash value and are not automatically reinstated.

6.6.      Package Transfers 

  • Unused package credits may be transferred only when transferability is included in the package description or approved by BCSpa in writing.
  • Credits already redeemed, forfeited, expired, or associated with a disputed payment may not be transferred.
  • The receiving client must complete all required intake, consent, and eligibility documentation before receiving services.
  • BCSpa may limit the number of transfers or refuse a transfer where fraud, resale, misuse, or safety concerns are present.

6.7.       Package Refunds 

  • Packages are generally nonrefundable after the applicable cancellation period has passed or after any credit has been redeemed, except where otherwise required by law.
  • Approved refunds may be reduced by the regular nonpackage value of services already received, payment-processing costs where legally permitted, and any nonrefundable charges disclosed at purchase.
  • Package credits have no cash value and may not be exchanged for cash.

6.8.       Cancellations, Late Cancellations + No-Shows

  • Package appointments are subject to the Cancellation & Appointment Policy.
  • A late cancellation may result in the deduction of the equivalent credit value or a charge equal to 50% of the regular service price, as stated in Section 7.
  • A no-show may result in forfeiture of the full credit value assigned to the scheduled appointment.
  • If BCSpa cancels the appointment, the affected credit will be restored.

6.9.       Gift Cards + Gift Certificates

  • BCSpa gift cards and gift certificates are separate from prepaid service packages and memberships.
  • Gift cards and gift certificates purchased on or after December 10, 2022 will not expire earlier than nine years from the date of purchase, or any longer period required by applicable law.
  • Fees that reduce the value of a gift card or gift certificate will not be imposed except where expressly permitted by law.
  • Any cash-redemption rights will be honored as required by applicable New York law.
  • Gift-card terms will be disclosed before purchase and included with the electronic or physical certificate.


7. Appointment Scheduling and Cancellation

7.1.      Cancellation & Rescheduling 

  • Members may cancel or reschedule an appointment without penalty by providing at least 12 hours’ notice.

7.2.      Late Cancellations 

  • Appointments canceled or rescheduled less than 12 hours before the scheduled start time will be charged 50% of the regular service price. BCSpa may deduct the equivalent value from an available membership credit.

7.3.      No-Shows 

  •  Members who do not attend a scheduled appointment and fail to provide notice will be charged 100% of the regular service price or forfeit the applicable membership session or credit. 

7.4.       Late Arrivals 

  •  If BCSpa cancels an appointment, the affected membership session or credit will be restored, and the member may reschedule without penalty. 


8. Membership Freezes and Cancellations

8.1.      Membership Freeze 

  •  Members may request to freeze an eligible membership for up to three months during a membership year. Requests must be submitted in writing and are subject to the terms of the selected plan and written approval by BCSpa. 

8.2.      Freeze Confirmation  

  •  A freeze is not effective until confirmed by BCSpa. Billing, benefits, expiration dates, and rollover eligibility during the freeze will be addressed in the written confirmation.  

8.3.     Member Cancellation 

  • Members may request cancellation through any cancellation method made available by BCSpa, including applicable online, email, telephone, mail, or in-person options. Cancellation will be processed without unreasonable delay and will prevent future charges after the effective cancellation date. 

8.4.       Legally Required Cancellation Rights 

  • BCSpa will honor all cancellation rights required by applicable law, including any applicable cooling-off period or rights arising from relocation, qualifying disability, closure, discontinuation of contracted services, or other legally recognized circumstances. New York’s Attorney General states that covered spa or health-club contracts may carry specific cancellation rights, including a three-business-day cancellation period. 

8.5.      Partial Billing Periods 

  • Membership fees are not prorated for partial billing periods unless required by law or expressly stated in the selected membership plan. 


9.  Refunds, Credits & Transfers 

9.1.     Membership Fees 

  • Membership payments are generally nonrefundable after the applicable cancellation period has passed and benefits have become available, except when otherwise stated or required by law. 

9.2.      Used Benefits 

  •  No refund will be issued for services, benefits, or discounts already used. 

9.3.      Unused Credits 

  • Unused membership credits are governed by the rollover, expiration, freeze, and cancellation provisions of the selected membership plan. Package credits are governed by Section 6. Gift cards and gift certificates are governed by Section 6.9 and applicable law.

9.4.      Membership Transfers 

  • Membership benefits may not be transferred unless transferability is expressly included in the selected plan or approved by BCSpa in writing. Package transfers are governed by Section 6.6. Gift cards may be used by the lawful holder subject to their stated terms.


10.  Changes, Suspension & Termination 

10.1.     Changes to Membership Terms 

  • BCSpa may revise membership benefits, administrative procedures, or other terms when reasonably necessary. Members will receive notice of material changes as required by applicable law. 

10.2.      Membership Suspension 

  • BCSpa may temporarily suspend a membership because of failed payments, unresolved balances, policy violations, safety concerns, or misuse of membership benefits. 

10.3.      Termination by BCSpa 

  • BCSpa may terminate a membership because of fraud, harassment, threatening or inappropriate behavior, illegal activity, repeated policy violations, unauthorized sharing, or conduct that compromises the safety or well-being of staff, providers, members, or guests. 

10.4.      Effect of Termination 

  • Any refund or remaining benefit following termination will be determined according to the reason for termination, services already provided, the selected membership terms, and applicable law. 


11.  Member Conduct, Health & Liability 

11.1.      Professional Conduct 

  •  Members must behave respectfully and appropriately while receiving services, visiting BCSpa locations, communicating with staff, or participating in BCSpa programs and events. 

11.2.      Health Information 

  •  Members are responsible for providing complete and accurate health information and reporting any medical condition, injury, allergy, pregnancy, medication, or health change that may affect service safety. 

11.3.      Medical Care 

  •  BCSpa wellness services are not substitutes for medical diagnosis, emergency treatment, or care from a licensed medical provider. Certain services may require medical clearance or a Letter of Medical Necessity. 

11.4.        Limitation of Liability 

  • Members are responsible for safeguarding their personal belongings. BCSpa is not responsible for lost, stolen, or damaged property except where responsibility cannot legally be excluded. 

11.5.      Partial Billing Periods 

  •  To the fullest extent permitted by law, BCSpa is not responsible for indirect, incidental, or consequential losses arising from membership use. Nothing in this Membership Policy waives any consumer right or legal protection that cannot lawfully be waived. 


12. Governing Law

12.1.     Applicable Law 

  • This Membership Policy is governed by the laws of the State of New York, without regard to conflict-of-law principles. 

12.2.     Jurisdiction 

  •  Any dispute arising from a BCSpa membership will be handled in an appropriate court located within the State of New York unless applicable law requires otherwise.
